With the introduction of SB88, it appears the overtime
issue for professional employees in the computer software field will be
resolved. The bill is making progress through the legislative system, and
on May 23, 2000 was amended to increase the sense of urgency for passing
this bill.
The summary of the new bill is:
Provides that a professional employee in the computer software field shall
be exempt from the requirement of premium overtime pay if the employee is
primarily engaged in specified duties, the employee is highly skilled, as
specified, and the employee's hourly rate of pay is not less than a specified
amount, $41.00, to be adjusted annually.
With the passage of SB88, it will eliminate the need for consultants to
get prior authorization from IMS to work overtime. Client approval will
be sufficient for working overtime hours. Should this bill pass as expected,
it will also eliminate the need, in most cases, to bill our clients for
the additional cost of overtime.
